Mark P. Welhouse and Welhouse & Associates, Inc. investigated by SEC

Halling & Cayo S.C. is researching potential claims for recovery of investment losses for investors with Mark P. Welhouse and Welhouse & Associates as a result of losses suffered relating to “SPY” options trading and allegations of misconduct by the Securities and Exchange Commission. Attorney Sean M. Sweeney is a member of the Public Investors Arbitration Bar Association (PIABA) and has represented numerous investors in recovering their funds in Financial Industry Regulatory Authority (FINRA) arbitrations. We are actively researching potential claims for investors with Mr. Welhouse and Welhouse & Associates.

The SEC has alleged that Mark P. Welhouse with Welhouse & Associates, Inc. was engaged in a “cherry-picking scheme” by unfairly allocating options trades for his customers in Wisconsin in an S&P 500 ETF called SPY. The SEC alleges that

Mr. Welhouse’s clients were not aware that he was trading options in their accounts, or that he was using those accounts to further his own interests by cherry-picking profitable day trades.

The SEC alleges that it analyzed the accounts and found the following results:

The SEC has demanded that Mr. Welhouse and Welhouse & Associates, Inc. respond to its complaint and has asked that a hearing be set and for an order for Mr. Welhouse to cease and desist his activities be issued. The SEC, at this point, has not asked that any compensation for the customers that lost their money be ordered in that proceeding. You can see the SEC order in its entirety here – SEC Order – Mark P. Welhouse.

Halling & Cayo S.C. is researching bringing claims on behalf of individual(s) and/or a group of investors for recovery of their funds. Most customers will have signed a FINRA arbitration agreement to resolve disputes, including claims for reimbursement of these types of investment losses. As the SEC reminds investors, it can be important to find an attorney that “specializes in resolving securities complaints.”
